These Terms of Service ("Terms") govern your use of the mobile application Eggbits, its widget and its Apple Watch app (together, the "App"), published by Raxoon Studios ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Eggbits is a virtual creature-raising game: you hatch an egg, take care of the creature that emerges, train it, watch it grow through the eras of video games, and carry its lineage on from generation to generation. The App is provided for entertainment purposes only.
Game time follows real time: your creatures keep living while the App is closed. In Retro mode, prolonged neglect can end a creature's life; in Cozy mode, a neglected creature goes on a trip and then comes back. These mechanics are part of the game and give rise to no compensation.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and Apple's Media Services Terms and Conditions.
You may not: (a) copy, modify, decompile, reverse-engineer or create derivative works of the App; (b) use the App for any unlawful purpose; (c) interfere with the App's operation, or manipulate its save data or clock to circumvent its rules.
3. In-App Purchases
The App offers optional one-time (non-consumable) purchases, processed by Apple through your Apple Account:
- No Ads — permanently removes advertising.
- Unlimited — permanently removes advertising and allows you to raise an unlimited number of creatures at the same time (the free version allows four active creatures in total, while boarding remains unlimited).
Payment is charged to your Apple Account. Prices are shown in the App before purchase and may vary by region. Purchases can be restored via the "Restore Purchases" button. Except where required by law, purchases are non-refundable; refund requests are handled by Apple at reportaproblem.apple.com. If Unlimited is refunded, no creature is removed, but you will not be able to add more while the number of active creatures exceeds the free limit.
4. Advertising
The free version of the App displays advertising provided by Unity Ads (Unity Technologies): banners in some tabs, an optional full-screen support ad from Settings, and optional rewarded videos. No ad appears during a game. When no ad is available, the App may show promotions for other Raxoon Studios apps. Advertising is removed for users who purchase No Ads or Unlimited; rewards from the optional videos are then granted without a video. 5. Your Creatures and Your Save Data
Your creatures and their family are stored only on your device and your Apple Watch. We keep no copy: deleting the App, or losing or resetting your device, may result in the permanent loss of your save data. Releasing a creature is irreversible, after a double confirmation.
6. Intellectual Property
The App, including its creatures, design, pixel-art graphics, sounds, the Raxoon mascot, logos and the Raxoon Studios brand, is owned by Raxoon Studios and protected by intellectual property laws. These Terms grant you no rights to our trademarks or content other than the license in Section 2.
7. Availability and Changes
We may update, modify or discontinue the App or any feature at any time. We may update these Terms; material changes will be indicated by updating the effective date above, and continued use of the App after changes constitutes acceptance.
8. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Reminders are local notifications whose display depends on your device's settings (Focus mode, permissions); we do not guarantee their delivery.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Raxoon Studios shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the App, including the loss of a save. Our total liability for any claim relating to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the statutory rights of consumers in the European Union.
10. Termination
You may stop using the App at any time by deleting it. The license ends automatically if you breach these Terms.
11. Governing Law
These Terms are governed by French law. Mandatory consumer-protection provisions of your country of residence remain unaffected. Any dispute that cannot be resolved amicably shall be submitted to the competent courts under French law. EU consumers may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr
In accordance with Articles L.611-1 et seq. of the French Consumer Code (Code de la consommation), you may use a consumer mediator free of charge to seek an amicable resolution of any dispute.

Support subscriptions
Monthly support (€2.99/month in France) includes No Ads while active. Annual support (€14.99/year in France, billed annually) includes No Ads and Unlimited while active. They are alternatives in the same subscription group and do not stack. Apple displays your local price before purchase.
Subscriptions renew automatically unless cancelled in your Apple Account settings before the period ends. Use Manage Subscription in the Shop. Deleting the app does not cancel a subscription. Existing permanent purchases remain valid; subscribing does not automatically refund earlier purchases. When a subscription expires, its benefits end without deleting creatures.
Android and Google Play
Eggbits also supports compatible Android devices and Wear OS. For this version, Google Play handles billing, refunds and subscription management through your Google Account. The Apple billing references above apply only to the Apple version. The store shows local prices and the billing period before purchase. The same No Ads, Unlimited, monthly support and annual support benefits apply. Apple and Google Play purchases are separate and do not transfer between stores. Uninstalling the app does not cancel a subscription. Use Manage subscription or Google Play settings. The license also covers compatible Android devices you own or control, subject to Google Play terms.
