These Terms of Use ("Terms") govern your use of the Chromatch mobile application (the "Application"), published by Raxoon Studios. By downloading or using the Application, you agree to these Terms. If you do not agree to them, do not use the Application.
1. The Application
Chromatch is a collection of color-based games (color reproduction, perception, memorization, and related mini-games). The Application is provided for entertainment purposes only. The scores and results do not in any way constitute a medical, optometric, or professional assessment.
2. License
We grant you a personal, non-exclusive, non-transferable, and revocable license to use the Application on Apple devices that you own or control, in accordance with these Terms and Apple's Media Services Terms and Conditions.
You are prohibited from: (a) copying, modifying, decompiling, reverse-engineering, or creating derivative works of the Application; (b) using the Application for any unlawful purposes; (c) disrupting the operation of the Application, cheating, or manipulating scores and leaderboards through automated means or by exploiting vulnerabilities.
3. In-App Purchases and Subscriptions
The Application offers optional purchases processed by Apple through your Apple account:
- Remove Ads — a one-time purchase that permanently removes advertising.
- Monthly Support and Annual Support — auto-renewing subscriptions that remove advertising and unlock supporter benefits (exclusive themes, supporter badge, advanced statistics, and early access to new games).
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in Settings → Apple ID → Subscriptions. Payment is charged to your Apple account. Prices are displayed in the Application before any purchase and may vary by region. Purchases can be restored via the "Restore Purchases" button. Unless otherwise required by law, purchases are non-refundable; refund requests are handled by Apple at reportaproblem.apple.com.
4. Advertising
The free version of the Application displays third-party ads (banners, interstitials, and optional rewarded ads) provided by Start.io. Watching a rewarded ad is always voluntary. Advertising is removed for users who have purchased "Remove Ads" or have an active support subscription. For details on advertising-related data, please see our Privacy Policy.
5. Game Center
Leaderboards, achievements, and multiplayer features use Apple Game Center and are subject to Apple's terms. Your Game Center nickname and your scores may be visible to other players. We may remove scores that we reasonably believe are the result of cheating or the exploitation of a vulnerability.
6. Intellectual Property
The Application, including its games, design, graphics, mascot, logos, and the Raxoon Studios brand, is the property of Raxoon Studios and is protected by intellectual property law. These Terms do not grant you any rights to our trademarks or content other than the license provided in Section 2.
7. Availability and Modifications
We may update, modify, or discontinue the Application or any of its features at any time. We strive to keep the Application available but do not guarantee uninterrupted availability. We may modify these Terms; any substantial changes will be indicated by updating the effective date above, and your continued use of the Application constitutes acceptance.
8. Disclaimer of Warranties
The Application is provided "as is" and "as available", without warranty of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement. Color rendering depends on your device's screen and its settings (brightness, True Tone, Night Shift); we do not guarantee any color accuracy.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Raxoon Studios shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Application. Our total liability for any claim related to the Application shall not exceed the amount you paid us during the twelve (12) months preceding the claim. Nothing in these Terms excludes any liability that cannot be excluded by applicable law, including the statutory rights of consumers in the European Union.
10. Termination
We may suspend or terminate your access to online features (such as leaderboards) for any violation of these Terms, particularly in the event of cheating. You can stop using the Application at any time by deleting it.
11. Governing Law
These Terms are governed by French law. The mandatory consumer protection provisions of your country of residence remain applicable. Any dispute that cannot be resolved amicably shall be submitted to the competent courts under French law. EU consumers can also use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
