1. Purpose
These terms govern the use of the mobile application Wakoon ("the Application"), published by Raxoon Studios. By downloading or using the Application, you agree to these terms.
2. Service Description
Wakoon prevents a computer from sleeping or locking: the phone, placed under an optical mouse, scrolls a pattern on the screen, adjusts the brightness, and can vibrate, so that the mouse's sensor detects movement. The Application installs no software on your computer, does not connect to it, and does not access it in any way.
3. Acceptable Use
You are solely responsible for your use of the Application. You agree in particular not to use the Application when it contravenes your employer's internal rules, IT policy, employment contract, or any other applicable rule, or any law or regulation in force.
The Application is a convenience tool (to prevent sleep mode during reading, a presentation, a download, etc.). It is not intended to deceive an employer, a client, or a time tracking system. Raxoon Studios disclaims all liability for use that contradicts the rules applicable to the user, including any disciplinary, contractual, or legal consequences.
4. Compatibility — No Guarantee of Functionality
The effectiveness of the Application depends on the hardware used. It is designed for mice with a visible red light optical sensor. Mice with a laser or infrared sensor are not supported, although they may work occasionally. The result also depends on the maximum brightness and vibration strength of your device. No guarantee of compatibility with any particular hardware is provided.
5. In-App Purchases and Subscriptions
The Application is free and financed by advertising. Optional purchases are offered:
- Ad Removal — a one-time, non-consumable purchase, valid for the Apple account that made the purchase.
- Monthly Support Subscription and Annual Support Subscription — they also remove ads.
- An optional ad video allows you to remove ads for 24 hours, without a purchase.
Subscription terms:
- Payment is charged to your Apple account at the confirmation of purchase.
- The subscription automatically renews unless canceled at least 24 hours before the end of the current period.
- The renewal is charged within 24 hours before the end of the period.
- You can manage or cancel your subscription at any time in your App Store account settings.
- The displayed prices are subject to change; any modification will be notified to you in accordance with Apple's rules.
6. Payments and Refunds
Purchases are made and billed by Apple. Raxoon Studios does not have the ability to issue refunds directly. Refund requests must be directed to Apple: reportaproblem.apple.com.
7. Advertising
The free version displays ads provided by third parties. The associated data processing is described in our privacy policy. We do not control the content of the ads displayed by our partners.
8. Intellectual Property
The Application, its name, its logo, its graphics, and its code are the property of Raxoon Studios and are protected. You are granted a personal, non-exclusive, and non-transferable right of use. It is forbidden to decompile, modify, resell, or redistribute the Application, except to the extent permitted by law.
9. Disclaimer of Warranty
The Application is provided "as is," without warranty of continuous, error-free operation, or fitness for a particular purpose, to the extent permitted by applicable law. Mandatory legal warranties (in particular the warranty of conformity provided by French consumer law) remain applicable.
10. Limitation of Liability
To the extent permitted by law, Raxoon Studios shall not be held liable for indirect damages resulting from the use of the Application, including: data loss, professional sanctions, device wear and tear or energy consumption, or hardware incompatibility.
Usage note: the Application keeps the screen on and adjusts its brightness, which increases energy consumption. Prolonged use with the screen on may accelerate battery wear.
11. Termination
You may stop using the Application at any time by uninstalling it. We may suspend or discontinue the distribution of the Application, without this entitling you to compensation beyond any sums that may be due.
12. Applicable Law
These terms are subject to French law. In the event of a dispute, an amicable solution will be sought first. Consumers may resort to consumer mediation and the European online dispute resolution platform.
